October 6, 2023Show Me The Justice  Congratulations to Defense Attorneys Beth Exley and Abbie Russell for earning Habeas Corpus Relief for your client in Cause Number 1822734 out of the 178th Criminal District Court.

The defendant was charged with Continuous Sexual Abuse of a Child in 2019 and the case was dismissed on a trial setting in 2020 for Missing Witness.  This Continuous Sexual Abuse of a Child was used a basis for a Motion to Adjudicate Guilt on a prior Aggravated Assault Family Member Deferred. The Motion to Adjudicate hearing was held in 2020 and the judge found NO allegations to be true – including the Continuous Sexual Abuse of a Child.  The same Continuous Sexual Abuse of a Child was REFILED in 2022 and the defendant re-arrested.  On September 28, 2023 judge decided that the REFILED case should be dismissed based on collateral estoppel since she found the allegations to be untrue in the Motion to Adjudicate hearing.
