Jury Trial Season On Hold (March 16th – October 1st)

Current Plan: Trial jurors will be congregated at NRG Arena on or near October 1, 2020 and jury selection will take place at NRG. Parking will be free for all participants (lawyers, jurors, clerks). Once the jury is selected the trial itself will be held the next working day at the criminal courthouse. Criminal jury trials will take precedence over civil jury trials. They will have pre-screening at the NRG door and masks will be mandatory to enter. (Judges have discretion on the masks once jurors are within their voir dire space.) These plans are tentative depending on spike of COVID cases. Also, the Harris County Criminal Lawyers Association has reservations about the above process since they were excluded from any and all input.

The following cases are felony and misdemeanor trial setting dismissals derived from the Harris County District Clerk’s website – online services > public data sets > crimdisposdaily. (2 work days later) I examine each dismissal form before posting, post only those defendants who are free of charges (exceptions apply) and for which I have an attorney photo. ric court dismissals are posted only if legal issues were cited.

CRIMINAL LAW INSTITUTE, INC. – Veteran Criminal Defense Attorneys Robert Pelton (pictured right), Joe Pelton and Former Congressman and District Court Judge Ted Poe (pictured left) have an online CLE class that is conducted each week in lieu of their in person class that Robert Pelton and Jim Skelton conducted for years at the Harris County Courthouse.

BAIL BOND EXPERTS

Congratulations to Defense Attorneys Brent Mayr (left) and Sierra Tabone for their successful appeal to the First Court of Appeals to release their client from custody. (Case Numbers 1657519 – 1657521) Their client posted surety bonds after arrest but when the client attended court and the DA read the Probable Cause to the judge the client was then put back into custody without cause (other than the judge was apparently unhappy with the magistrates original bond amounts) Following this successful ruling several other lawyers filed a grievance against this district court judge for similar bond revocation instances. HOUSTON CHRONICLE AUGUST 30, 2020

Note: August 31, 2020 – Back inside the courtroom – Brent Mayr’s client was placed BACK INTO CUSTODY by the judge in disregard of the Court of Appeals ruling AND per Sierra the judge revoked (4) other defendant’s bonds and placed them into custody.
