September 13, 2025 Show Me The Justice presents WAR STORIES

Jeff Ross is a criminal defense attorney – His story:

THE DAY I HAD 17 TRIALS SET ON THE FELONY DOCKET

   It was May 1985 and I was a number three prosecutor in the 185th District Court – George Walker presiding.  He was an ornery person who never smiled.  John Petruzzi was my chief.  I had been in that court for just a couple of weeks and was getting my bearings.

   I had seventeen – REPEAT – SEVENTEEN trials set for that Monday.  I had subpoenaed 105 witnesses.  I spent my entire Sunday prepping for the first six trials on the docket on the assumption that one of those six would go to trial.  I was ready!

   It was Monday and we had our usual docket matters.  A jury panel was waiting in the hall.  Petruzzi – unbeknownst to me – worked out my first six trial cases – the ones I was prepared for.  Judge Walker called number seven to trial!  I HAD NO IDEA what trial number seven case was all about.  I did not read the case the day before!  It was an Assault on a Peace Officer – enhanced to a habitual offender – 25 to life! 

   I frantically asked the bailiff, who was tasked with sending out the subpoenas – where my witnesses were?  He said he did not send out the subpoenas.  “You didn’t send out 105 subpoenas?” “No, sorry!”  I had NO witnesses in court!

   We had voir dire on the case from 10:30a – 12p.  The jury was sworn.  We took a 12-1p lunch break.  I frantically tried calling my witnesses, but to no avail.  We didn’t have cell phones back then. At 12:55p the judge told me he was ready to come out and I had nothing!  NO witnesses, NO evidence!  The jury was back from lunch and ready to hear my case.  At 1p I saw the defense attorney and defendant sitting at the defense table ready for my evidence.  I asked the defense attorney to come over to me and I said “I am in a good mood today, would your client take one year in the county jail?”   They jumped on it and we took the plea.  A minute later – I would have had to dismiss the case and experience extreme embarrassment.  My bluff worked – but that was the WORST five minutes of my ADA career and the worst Monday morning of my life!


I interviewed 12 of some of the best court reporters working the Harris County Criminal Courts and got their “inside information” on how jurors, lawyers, witnesses and judges can improve in trial to make it easier for the court reporter to take down ALL the information required of them for an excellent record.
